Victim Surcharge

The victim surcharge rates below apply to all offences committed on or after 1 October 2012.

If the defendant is sentenced for any offences committed before 1 October 2012 the 2007 rules apply.

The surcharge is applied to the most serious penalty applied when sentencing (i.e. the highest fine or the longest period of imprisonment).

Victim surcharges do not currently apply to any custodial sentences in the magistrates’ court.

Adults

Community sentence £60.00

Suspended sentence of six months and below £80.00

Suspended sentence of more than six months but less than 12 months £100.00

Imprisonment/YOI of less than 6 months £80.00

Imprisonment/YOI of more than 6 months up to 2 years £100.00

Imprisonment/YOI of more than 2 years £120.00

Youths (under 18 on the date of the offence)

Conditional discharge £10.00

Fine, YRO, Referral order £15.00

Cusody £20.00

Conditional discharge £15.00

Fine 10% of the fine (minimum £20.00 maximum £120)
